These Terms of Service (“Terms”) govern your access to and use of the websites, dashboards, business modules and related services (collectively, the “Services”) operated by TidalWave Axis LLC, a Wyoming limited liability company (“TidalWaveAxis,” “we,” “us,” or “our”). By accessing or using the Services you agree to these Terms. If you do not agree, do not use the Services.
TidalWaveAxis provides ready-made business websites, optional subscription-based functional modules, hosting of customer dashboards and portals, and custom software development services. Specific features, modules and plans are described on our site at the time of purchase and may evolve over time.
You are responsible for the accuracy of the information you provide, for safeguarding your credentials, and for all activity under your account. You must notify us promptly of any unauthorized use. Accounts created for your customers (end-customer portal access) are scoped to your business only.
Plans and modules are billed on a recurring basis (monthly or annual) through our payment processor. Prices in effect at the time of purchase apply for the current billing period; renewal prices will be communicated before they take effect. You may cancel any subscription at any time from your dashboard — cancellation stops future renewals and module access ends at the close of the paid period. Fees already paid are non-refundable except where required by law.
Your business data remains yours. If you cancel, you may request a complete export of your data. Following cancellation, your data is retained for 90 days (during which you can download your export or reactivate) and is then permanently deleted from our systems, except for records we are legally required to keep (such as billing history). You agree not to use the Services for unlawful purposes; to infringe intellectual property; to send spam; to attempt unauthorized access to our systems or other customers’ data; or to upload malicious code. We may suspend or terminate Services that violate these rules, with notice where practicable.
We retain all rights to the TidalWaveAxis platform, module software, designs and branding. You receive a non-exclusive, non-transferable license to use the Services while your subscription is active. Content you upload remains yours; you grant us only the rights needed to host and display it as part of your Services.
We work to keep the Services available and backed up, but they are provided “as is” and “as available” without warranties of any kind, express or implied. Scheduled maintenance and factors outside our control may cause temporary interruptions.
To the maximum extent permitted by law, TidalWave Axis LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenues or data. Our total liability for any claim relating to the Services is limited to the amounts you paid us in the twelve (12) months before the event giving rise to the claim.
We may update these Terms from time to time. Material changes will be announced on this page (and by email for active subscribers) before they take effect. Continued use of the Services after changes take effect constitutes acceptance.
These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law rules.
